  • WSU requires its faculty, staff and students to comply with copyright law. To comply with copyright law, copyrighted materials may require permission or a license before they can be used. A CougPack is likely to require permissions if the material in the CougPack does not qualify for Fair Use. Visit University Marketing and Communication's (UMC) website for more information about copyright.
  • If you print or have a printing service make copies of journal articles, texts, references or other materials to create CougPacks or otherwise make the materials available for your students, you have full responsibility to ensure your use of the material is legally permissible. If you determine that you need copyright permissions, you can obtain any necessary license or permission from the rights holder. A convenient way to do so is to make use of the Copyright Clearance Center. Visit the UMC website for more information about obtaining permissions.
  • You may also use some materials based on Fair Use. Before doing so, you need to make an analysis of whether a Fair Use exception applies to the material. To determine whether a use of the material can be based on Fair Use, consider:
  • (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
    (2) the nature of the copyrighted work;
    (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
    (4) the effect of the use upon the potential market for or value of the copyrighted work.

    No one factor is determinative. Weigh the factors to determine whether your use is likely a Fair Use. For the fourth factor, consider both the market for the original work and the permissions royalties market.
